Idaho Law
Who Can Serve Process in Idaho
Governed by Idaho Rules of Civil Procedure Rule 4.

Under Idaho R. Civ. P. 4(c), service of process in Idaho may be made by the sheriff of the county where service is effected, a deputy sheriff, or by any other person who is not a party and is at least 18 years old. Idaho does not require statewide licensing of private process servers, but sheriff-coordinated service remains the default in rural counties where local relationships and geography matter.

Personal service is the default under IRCP Rule 4(d)(2)(A). Substituted service may be effected under Rule 4(d)(2)(B) by leaving a copy at the individual's dwelling house or usual place of abode with some person over the age of 18 residing therein. Service on entities is governed by Rule 4(d)(4). Service outside Idaho uses Rule 4(e), and service by publication under Rule 4(f) requires a court order after diligent-search showing. Return of service is governed by Rule 4(g).

Key rule to know: Idaho's substituted-service age threshold is 18 (not 15 as in Florida or 14 as in Arkansas). A return showing substituted service on a minor under 18 can be quashed. We verify age on the return every time. Idaho R. Civ. P. 4(c), 4(d), 4(e), 4(f), 4(g); Idaho Code §§9-2001 et seq. (UIDDA)

What this means for your case

Idaho is a big state with stretches of long rural distances — a 300-mile trip from Boise to Sandpoint isn't unusual. A server who tries to cover all 44 counties from a single office is going to fail on your attempt log. Served 123 LLC coordinates with sheriffs and local servers in every region: Treasure Valley, Magic Valley, eastern Idaho, the Panhandle, and the central mountains.

FAQ
Idaho Service of Process — Common Questions
Answered under the Idaho Rules of Civil Procedure. This is practical guidance, not legal advice.
Who can legally serve process in Idaho?
Under Idaho R. Civ. P. 4(c), service may be made by the sheriff of the county where service is effected, by a deputy sheriff, or by any other person who is not a party and is at least 18 years old. Idaho does not require statewide licensing of private process servers.
What Idaho rule governs service of process?
Idaho Rules of Civil Procedure Rule 4. Rule 4(d)(2) covers personal and substituted service on individuals, 4(d)(4) covers entities, 4(e) covers service outside Idaho, 4(f) covers service by publication, and 4(g) addresses return of service.
What is substituted service in Idaho?
Under Idaho R. Civ. P. 4(d)(2)(B), if personal service cannot be made, substituted service may be effected by leaving a copy of the summons and complaint at the individual's dwelling house or usual place of abode with some person over the age of 18 residing therein.
Do you serve in all 44 Idaho counties?
Yes. Served 123 LLC covers every one of the 44 Idaho counties — from Treasure Valley hubs Ada and Canyon through the Magic Valley, eastern Idaho and Tetons, central mountains, and the Panhandle. Hub counties (Ada, Canyon, Kootenai, Bonneville, Twin Falls) offer same-day rush capacity.
What must an Idaho Return of Service include?
Under IRCP Rule 4(g), the person serving process must make proof of service stating the date, time, place, and manner of service and identifying the person served. Service by a non-officer must be proven by affidavit. For substituted service, the return should confirm the recipient was over 18.
How fast can Served 123 LLC complete Idaho service?
Same-day service is available when we receive the request before 11:00 AM local time in Ada (Boise), Canyon, Kootenai (Coeur d'Alene), Bonneville (Idaho Falls), and Twin Falls counties. Next-day priority is available statewide.
What happens if the recipient is evading service?
We include free skip tracing and diligent re-attempts at varying times and days. Idaho allows service by publication under IRCP Rule 4(f) after a court order based on diligent-search showing — our attempt logs and GPS records support the motion.
Do you serve out-of-state subpoenas in Idaho?
Yes. Idaho has adopted the Uniform Interstate Depositions and Discovery Act (UIDDA) at Idaho Code §9-2001 et seq. We handle clerk intake, Idaho subpoena issuance, and service statewide. See our Idaho subpoena domestication page for the full process.
