Who Can Serve Process in Minnesota
Governed by Minnesota Rules of Civil Procedure Rule 4.

Under Minn. R. Civ. P. 4.02, service of process in Minnesota may be made by the sheriff of the county where service is effected, a sheriff's deputy, or by any person not less than 18 years of age who is not a party to the action. Minnesota does not require statewide licensing of private process servers, but district courts scrutinize returns tightly — particularly on whether substituted service was properly delivered to a household member.

Personal service is the default under Minn. R. Civ. P. 4.03(a). Substituted service may be effected by leaving a copy at the individual's usual place of abode with a person of suitable age and discretion then residing therein. Minnesota's "person residing therein" requirement is strict — a visitor, a housekeeper, or a neighbor who doesn't live at the address won't satisfy the rule. Service on entities is governed by Rule 4.03(c). Service outside Minnesota uses Rule 4.04 combined with the Long-Arm Statute at Minn. Stat. §543.19. Service by mail with acknowledgment is permitted under Rule 4.05.

Key rule to know: Minnesota's Rule 4.03(a) "residing therein" requirement is strict. Leaving a summons with a babysitter, a houseguest, or a landscaper does not satisfy substituted service — the person must actually live at the address. Every Minnesota return we file confirms the recipient's residency status. Minn. R. Civ. P. 4.02, 4.03, 4.04, 4.05, 4.044, 4.06; Minn. Stat. §543.19, §600.41
